Concern over our HOA board

“I’m just a volunteer,” during HOA meetings. What an excuse.

Mount Vista Homeowner Association Board: You have the fiduciary obligation of duty of loyalty and duty of care. I saved for years to purchase the home I live in and I don’t accept this “volunteer” stuff when I pay.

Members of the Board of Directors, you engage a former manager who says that same thing: “I’m just a volunteer.” Let me get this right: we are paying a management firm, but are still being directed by the former manager living in the neighborhood?”

The same is said as often: “We have insurance” and “Sue us.”

What? Why do we desire to potentially run up legal expenses by failure to comply with the bylaws recorded at the county especially since the association attorney has written that he could not be certain board-made rules (not voted in by membership) could not successfully be challenged in court?



Don’t all homeowners pay when something goes to court  when an association is sued? How much will our insurance go up? What will the legal costs be? Will the bank accept “I’m just volunteering to live in my house.”

Why won’t the current management firm “just volunteer?” This kind of volunteerism is not appreciated.
