Land patent is highest evidence of title

Posted

The land patent is the only evidence of the lawful fee simple title. Therefore, the land patent is the highest evidence of title and is conclusive of the ownership of the land in courts of competent jurisdiction.

This is why local governments have neglected to teach the people about land patents. The government by default has claimed ownership of the land that you the land owner think is your own. That is precisely why the government has gone back to a feudal system that is prohibited by the 1878 Constitution of the state of Washington. But, until the land owner brings the land patent forward in the land owners name, the state and county will continue to steal money from the land owner.

Fee simple means that the land can never be liened by government or banks. The consequence is that the government has no authority to tax the titled land owner. The 1889 Constitution of the state of Washington instituted the feudal system that the original lawful 1878 Constitution of the state of Washington prohibited.

Once a freeholder (citizen) claims sovereignty under the Article 2, Section 3, of the 1878 Constitution of the state of Washington, he/she can therefore, in law, bring forth the land patent in their name.

The patent is the instrument which, under the laws of the United States Congress, passes lawful title from the United States of America and when regular on its face, is conclusive evidence of title to the ownership of said land.

Congress having the sole power to declare the dignity and effect of its titles has declared the patent to be the superior and conclusive evidence of the lawful title.

Issuance of a government patent granting title to the land is the “most accredited type of conveyance known to our law.” [United States v. Creek Nation, 295 U.S. 103, 111, (1935); see also United States v. Creek Nation, 474 F. 2d 628, 634 (1973).]

The government wants to make you think that you cannot bring forward the land patent because it was lost because all the owners before you did not do that. Unfortunately, for the government all of the codicils that govern the land patent are in the land patent. The land patent continues in perpetuity for the heirs and assigns. The land patent is mute on the subject of reassignment. Therefore, the land owner at any time can bring the land patent forward into their name.

Therefore by all treaty law in existence covering land issues, the title to the land rests in the people. The corporate states, have stolen your titles and it is time to start getting them back.
