On Thursday, April 17, the Clark County Planning Commission recommended repealing a surface mining overlay after a state appeals court upheld a ruling that the county violated the State Environmental Policy Act.
The overlay, approved in 2022, allowed Granite Construction to mine more than 330 acres in Chelatchie.
The state’s Growth Management Hearings Board ruled the county needed to complete an environmental impact statement before granting approval, an opinion later affirmed by the Court of Appeals in March.
The commission’s vote marks the first formal step toward state law compliance. The county council will consider the repeal at a public hearing on May 20. Some commissioners raised concerns that the move could set a broader precedent for how the county handles future land-use decisions.
