BABI AND WENDY LOW, HUSBAND AND WIFE, INDIVIDUALLY AND THE MARITAL COMMUNITY COMPOSED THEREOF A writ of execution has been issued in the above captioned case, directed to the sheriff of Clark County, commanding the sheriff as follows: TO THE SHERIFF OF CLARK COUNTY, WASHINGTON: On January 24, 2020, the Superior Court of the State of Washington for Clark County entered a Default Judgment and Decree of Foreclosure in this lawsuit favor of plaintiff SBF Holdings, LLC, an Oregon limited liability company, ("SBF") against the defendants RBA International, LLC, a Washington limited liability company, and Rene P. Babi and Wendy Low, husband and wife, individually and the marital community composed thereof, jointly and severally, in the original amount of $1,872,821.26, said amount to bear interest at the rate of twenty (20%) percent per annum, compounded monthly, from the date of entry of said Default Judgment and Decree of Foreclosure until paid. Said Default Judgment and Decree of Foreclosure also decreed the judicial foreclosure of a Trust Deed, Assignment of Rents, Security Agreement, and Fixture Filing (the Babi/Low Trust Deed") recorded in the office of the Auditor of Clark County, Washington, on May 22, 2017, under Auditor's Recording No. 5405480, records of Clark County, Washington, as modified by the following documents - the Modification of Deed of Trust which was recorded in the office of the Auditor of Clark County, Washington, on September 17, 2018, under Auditor's Recording No. 5548197, records of Clark County, Washington; the Modification of Deed of Trust which was recorded in the office of the Auditor of Clark County, Washington, on October 31, 2018, under Auditor's Recording No. 5560527, records of Clark County, Washington; the Modification of Deed of Trust which was recorded in the office of the Auditor of Clark County, Washington, on November 20, 2018, under Auditor's Recording No. 5565628, records of Clark County, Washington; and the Assignment of Deed of Trust dated December 23, 2019, which was recorded in the office of the Auditor of Clark County, Washington, on January 2, 2020, under Auditor's Recording No. 5688336, records of Clark County, Washington; and directed the sale of certain real property located in Clark County, Washington, which is commonly known as: 14909 SE Rivercrest Drive Vancouver, Washington, 98683 and which bears the following legal description: Lot 20, Rivercrest Estates Phase I, according to the plat thereof, recorded in Vol. H of Plats, page 286, records of Clark County, Washington, a/k/a Tax Parcel No. 092008-058. All right, title and interest in the lien of the said Babi/Low Trust Deed and in the said Default Judgment and Decree of Foreclosure is now is held by SBF. The Default Judgment and Decree of Foreclosure was recorded with the Auditor of Clark County, Washington, on January 24, 2020, under Auditor's File No. 5695477, records of Clark County, Washington. The total amount owing on the said Default Judgment and Decree of Foreclosure as of this date is $1,885,228.84. Further interest will accrue thereon after this date as specified in the said Default Judgment and Decree of Foreclosure. THEREFORE, IN THE NAME OF THE STATE OF WASHINGTON, you are hereby directed to take this Writ of Execution and levy upon, seize and take into possession and execution, the real property of judgment debtors Rene P. Babi and Wendy Low, husband and wife, sufficient to execution, and sell said property, or so much thereof as may be necessary to satisfy the said Default Judgment and Decree of Foreclosure and post-judgment interest and costs, according to law. The real property you are commanded to levy upon, seize and take into possession and execution is that certain real property located in Clark County, Washington, which is commonly known as: 14909 SE Rivercrest Drive Vancouver, Washington, 98683 and which bears the following legal description: Lot 20, Rivercrest Estates Phase I, according to the plat thereof, recorded in Vol. H of Plats, page 286, records of Clark County, Washington, a/k/a Tax Parcel No. 092008-058. Apply the proceeds from the sale to satisfaction of the unpaid portion of the said Default Judgment and Decree of Foreclosure, together with interest and increased costs incurred in performing this Writ of Execution. You are further directed to endorse in ink on this Writ of Execution the day, hour and minute when the writ first came into your hands. Execute on this Writ of Execution and return it to the Clerk of the Court who issued it within sixty (60) days of its date along with a report of proceedings showing how you have executed on the writ. For purposes of sale, the return date for this Writ of Execution may be automatically extended for an additional thirty (30) days. The sale date has been set for April 24, 2020. YOU MAY HAVE A RIGHT TO EXEMPT PROPERTY from the sale under statutes of this state, including sections 6.13.010, 6.13.030, 6.13.040, 6.15.010, and 6.15.060 of the Revised Code of Washington, in the manner described in those statutes.
